Editor: While Tennessee State Rep. Mike Carter was killing Tennessee's "Defense of Natural Marriage Act" (HB1412) in committee claiming no successful cases of nullification could be proven because no statue or court case had been cited as proof. I am not sure, because I don't know Rep. Carter's heart, whether he understood the ignorance of those statements or whether he believed it was an artful way to get the the result he wanted and appear to look wise to those who didn't know better. NULLIFICATION, WHEN SUCCESSFUL, FREQUENTLY DOES NOT RESULT IN A COURT CASE ABOUT A STATUTE. More often than not the feds just back down quietly and pretend it never happened. It may be that since Rep. Carter is an attorney and a former judge that he cannot believe there are solutions to federal overreach that do not play out in the courts.
